Merchant warrants and covenants to City that all goods and services provided by Merchant, Merchant's subcontractors, and agents under the Agreement shall be free of defects and produced and performed in a skillful and workmanlike manner and shall comply with the specifications for said goods and services as set forth in this Agreement and the Proposal attached hereto and incorporated herein as Exhibit "A". Merchant warrants that the goods and services provided to City under this Agreement shall be free from defects in material and workmanship, for a period of five (5) years commencing on the date that City issues final written acceptance of the project.
