Buyer acknowledges that the purchase of the Property may have resulted from a transfer made by a mortgagee who acquired the Property at a foreclosure sale or by deed in lieu thereof. Buyer further acknowledges that the sale and purchase of the Property has been conducted at an auction, as described in Ky. Rev. Stat. Ann. § 324.360. Therefore, Seller is exempt from the requirement of executing a “seller’s disclosure of conditions form.” Further, regardless of how Seller obtained title, Seller is not familiar with the condition of the Property, other than as may be disclosed in any inspection reports obtained by or on behalf of Seller, Seller’s representatives or agents or that Seller may have received otherwise.
