This Commercial Lease Agreement ("Lease") is by and between DAVE, LLC, of 23806 Anna Court, Rapid City, SD 57702 ("Landlord") and the City of Rapid City, a municipal corporation of the State of South Dakota, of 300 Sixth Street, Rapid City, SD 57701 ("Tenant"). Landlord is the owner of land and improvements commonly known and numbered as 1911 Lombardy Drive, Rapid City, South Dakota and legally described as Lot 13C, Block 1, Lombardy Industrial Park, Rapid City, Pennington County, South Dakota (the "Leased Premises"). Landlord desires to lease the Leased Premises to Tenant, and Tenant desires to lease the Leased Premises from Landlord for the term, at the rental rate specified, and upon the covenants, conditions and provisions herein set forth. This Lease is effective once signed by all parties.
