This safe harbor agreement (Agreement) is made and entered into as of January 2012, between Duane Waddell, owner of Swallow Creek Ranch (Landowner), and the U.S. Department of the Interior, Fish and Wildlife Service (Service); hereafter collectively referred to as the “Parties” or singularly as “Party.” The purpose of this Agreement is to (1) maintain, and potentially increase, population numbers of the federally threatened California red-legged frog (Rana draytonii); and
