You have requested that our firm provide an opinion regarding the legal exposure of the Board of Education of the City of Stamford should the City of Stamford execute a proposed lease agreement with Saint Clement’s Parish Corporation (“Saint Clement’s”), a Roman Catholic Parish within the Diocese of Bridgeport. Under the terms of the lease, the City would rent space from Saint Clement’s for use by the Stamford Board of Education (the “Board”). The Board will use the leased space to house a portion of its Alternative Routes to Success (“A.R.T.S.”) program. The A.R.T.S. program provides educational opportunities to City students who would benefit from receiving instruction in an alternative setting.
