THIS AGREEMENT (“Agreement”) is made and entered into this day of , 2019, (the “Effective Date”), by and between the City of Chula Vista, a California Chartered Municipal Corporation (“City”), and the San Diego Metropolitan Transit System (“MTS”), a public transportation service provider, for the purpose of outlining and defining the roles, responsibilities, terms and conditions related to the maintenance of certain infrastructure that are part of the South Bay Rapid project (“Project”). The City and MTS may be referred to in this Agreement individually as a “party” and collectively as the “parties”.
