WHEREAS the Provincial Parties acknowledge that, as a result of the majority of the Supreme Court of Canada1 adopting Justice Donald’s conclusion2 that the Education Improvement Act3 was unconstitutional and of no force or effect, that the BCPSEA-BCTF collective agreement provisions that were deleted by the Public Education Flexibility and Choice Act in 2002 and again in 2012 by the Education Improvement Act are restored;
