CPV Shore, LLC (“CPV”) is pleased to submit the attached form of Standard Offer Capacity Agreement (“SOCA”) pursuant to the New Jersey Board of Public Utilities’ (“NJBPU”) February 10, 2011 order in Docket No. E011010026 initiating a proceeding to implement a Long-term Capacity Agreement Pilot Program ("LCAPP") as required by P.L. 2011, c. 9. The attached form of SOCA reflects an appropriate balance of risk between Suppliers and Buyers. However, to provide New Jersey ratepayers with the benefit of a highly competitive process and to ensure the most competitive market pricing, any proposed SOCA must be financeable in light of the requirements of today’s capital markets. To this end, we have highlighted the following key areas for the NJBPU and its Agent to consider in the development and adoption of the final form of SOCA.
