WHEREAS, on 10 November 2023, NorthPoint filed with the Commission (the Commission) of the Canada Energy Regulator (CER) a complaint (C27205), supplemented by an erratum (C27378) (together, the Complaint) against Manitoba Hydro. NorthPoint alleges that Manitoba Hydro has failed or refused to allow NorthPoint fair market access as required by Electricity Export Permit EPE-404 (Blanket Export Permit) issued by the National Energy Board on 30 July 2015 (A71555) and effective November 1, 2015.
