AGREEMENT AND EASEMENT FOR INSTALLATION OF DRIVEWAY PIPE UNDER HOUSTON COUNTY AGRICULTURAL POLICYAgreement And • March 9th, 2023
Whereas , who is the owner (“Owner”) of said PARCEL NUMBER (“Property”), has requested a driveway pipe to be installed by Houston County, Alabama (“County”), through the Houston County Road and Bridge Department. Under the County’s current policy, the County will install driveway pipes on the Property solely dedicated for agriculture without charge to the property owner. The Owner hereby agrees that the sole intention of this driveway installation is to serve the Property for agricultural purposes. The Owner hereby consents and agrees that for a time period of not less than two years from the date of installation of said driveway pipe, the Owner will neither construct nor allow to be constructed on the Property any residential structure. If a residential structure is constructed on the Property, the Owner shall either pay to the County an amount equal to the expense for all labor, equipment, and materials incurred in the installation of the pipe, or the County shall remove said pipe an
