This Services Agreement (“Agreement”) is an agreement between you as our customer (“Customer” or “you”) and governs your access to and use of the SignalFx cloud software services (collectively, the “Service”) provided by Splunk Inc. (“Splunk” or “we”). Use of and access to the Service is conditioned upon your compliance with this Agreement and all applicable local, state, national, and international laws, rules and regulations. Your use of the Service indicates your acceptance of this Agreement, and that you understand and agree to be bound by this Agreement. We may modify this Agreement (including any policies we reference) at any time by posting a revised version on our website or by otherwise notifying you in accordance with Section 11.6. The modified Agreement will become effective upon posting (“Effective Date”). By continuing to use the Service after the Effective Date, you agree to be bound by the modified Agreement.
