This Agreement for Services for the Bay Area Regional Energy Network Program Water Upgrades $ave (this “Agreement”) is dated [DATE] (“Effective Date”) and is between the Association of Bay Area Governments, a California joint powers authority (“ABAG”) and [Water Utility], (“Partner Utility”). The Agreement facilitates the implementation of Bay Area Regional Energy Network (“BayREN”) program Water Upgrades $ave (“Program”), which is funded in part by a Funding Agreement between ABAG, on behalf of BayREN, and Pacific Gas & Electric Company (“PG&E”) authorized by the California Public Utilities Commission (CPUC) Decision 15-10-028 approving, among other things, budget to fund implementation of BayREN activities through 2025. ABAG and Partner Utility may be referred to herein individually as a “Party” or collectively as the “Parties.”
