In accordance with the Family Educational Rights and Privacy Act, found at 34 C.F.R. 99 et seq. (hereinafter referred to as “FERPA”, as defined in Section 1.3), the Federal Health Insurance Portability and Accountability Act of 1996 and its related regulations (hereinafter referred to as “HIPAA”, as defined in Section 1.1) and the Health Information Technology for Economic and Clinical Health Act provisions of the American Recovery and Reinvestment Act of 2009, Pub. Law No 111-5 (“ARRA”, as defined in Section 1.2), (hereinafter referred to as “Business Associate”) hereby acknowledges and agrees that it is a “Business Associate” (as defined by HIPAA) of the Board of Regents of the University System of Georgia by and on behalf of the University of Georgia (“University”)(each a “Party” and collectively the “Parties”).
