As part of this obligation, Hybrid Entity must receive assurances from any business associate who receives or has access to Hybrid Entity’s Protected Health Information that the business associate will protect the information in the same way as Hybrid Entity.

Hybrid Entity, in addition to providing educational services, has certain business activities in the University Eye Center, Dental Hygiene Clinic, Ferris Pharmacy Care Clinic, and Birkam Health Center and identifies them as health care components. Hybrid Entity is also an employer that sponsors one or more health plans. Pursuant to federal laws and regulations, including the Administrative Simplification provisions of the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), Hybrid Entity has to protect certain health information of its customers and has certified to its health plans that it will protect the privacy of Protected Health Information (“Protected Health Information”). As part of this obligation, Hybrid Entity must receive assurances from any business associate who receives or has access to Hybrid Entity’s Protected Health Information that the business associate will protect the information in the same way as Hybrid Entity.
