THIS INDEFEASIBLE RIGHT OF USE AGREEMENT (the “Agreement”) is made and dated as of , 2009, by and between Comcast of Arkansas/Florida/Louisiana/Minnesota/Mississippi/Tennessee, Inc., a Delaware corporation, having a place of business at 10 River Park Plaza, St. Paul, MN 55107 (hereinafter referred to as “Comcast”), and the City of Minneapolis, a city in the state of Minnesota (hereinafter referred to as “the City“). Comcast and the City may, at times, be referred to as a “Party” or collectively referred to as the “Parties” as the context requires.
