The Lake Tahoe basin straddles the Nevada-California state line with approximately two-thirds of the basin in California and one-third in Nevada. In the late 1960’s, an Interstate Compact between the two states was drafted and ultimately ratified by both states. The Compact set forth provisions for the equitable apportionment of waters between the two states. The provisional annual allocation of the waters of the Lake Tahoe Basin for the State of Nevada and for the State of California is 11,000 and 23,000 acre-feet, respectively, for use within their portions of the Lake Tahoe Basin. Water collected after its use (e.g., effluent) does not count against the allocation to either state and may be exported out of the basin. Although Congress never approved the Compact, provisions from the Compact were inserted and affirmed in the passing of Public Law (PL) 101-618 (Settlement Act) on November 16, 1990.
