WHEREAS, This Agreement is entered into this _ day of , 2013, by and between the City of Tucson (“City” or “Tucson Water”) and the Vail Water Company (“Vail” or “Company”), a public service corporation regulated by the Arizona Corporation Commission relating to the delivery of the Company’s Central Arizona Project (CAP) water through the Tucson Water potable distribution system, also referred to as wheeling.
