The undersigned Customer agrees that these Support, Managed and Subscription Services Terms (the “Agreement”) will govern the purchase of certain Services described below by Customer from Avaya World Services Inc. (“Avaya”). The “Effective Date” of this Agreement is the date Avaya accepts an order in accordance with Section 1.1 below and continues until terminated in accordance with Section 6 below. “Avaya” means, as the context requires, either Avaya World Services Inc. or the appropriate Avaya Affiliate or permitted assignee accepting an order under this Agreement from Customer or its Affiliate. “Customer” means, as the context requires, either the named Customer signing this Agreement or the appropriate Customer Affiliate for a given country issuing an order under this Agreement upon an Avaya Affiliate. Incorporated into this Agreement by reference are Schedule A –Personal Data Processing (Privacy) Terms.
