These terms and conditions together with the Application, the fees, all other documents incorporated by reference herein and any other term we may make available to you (this "Agreement") are provided by The Toronto-Dominion Bank ("we", "us" and "our") in connection with the provision of merchant products and services ("Merchant Services") to you, so that your customers may pay for your goods and services by means of credit cards and/or debit cards. References in this Agreement to the "merchant", "you" and "your" refer to the merchant who completed and submitted an application for TD Merchant Services (an "Application") to us, or on whose behalf an Application was completed and submitted to us. Your use of any Merchant Services means that you have read and agree to be bound by this Agreement and that you will pay all fees and charges provided for under this Agreement.
