Developer also agreed to pay a subsidy to the affordable housing developer selected by Developer, AMCAL Pacific Pointe Fund, L.P., a California limited partnership (“AMCAL”), as and when needed to fill any gap financing necessary in order to build the 50% AMI Units on Block 49 (as defined in the Sixth Amendment, the “Block 49 Subsidy”).
