The BOARD is to remain in operation throughout the life of the active CONSTRUCTION CONTRACT and, if needed, for a reasonable post-construction period following final acceptance of the project, but not to exceed the date the DEPARTMENT administratively closes the CONSTRUCTION CONTRACT for construction of the project. Any disputes or claims that were not resolved prior to Financial Acceptance of the project pursuant to 5-11 must be referred to the BOARD within 90 calendar days after Final Acceptance on projects with an original Contract amount of $3,000,000 or less, and within 180 calendar days after Final Acceptance on projects with an original Contract amount greater than $3,000,000.
