This AMENDED AND RESTATED INTERIM WATER SUPPLY AGREEMENT (this “Agreement”) is entered into as of this the ____ day of __________, 2024 (the “Effective Date”), by and between the GULF COAST WATER AUTHORITY, a conservation and reclamation district of the State of Texas (the “Authority”), and THE CITY OF GALVESTON, TEXAS, a municipal corporation and home rule city of the State of Texas (the “Customer”). Each of the Authority and Customer may be referred to herein as a “Party” and collectively as the “Parties.” This Agreement completely amends, replaces and supersedes any prior agreements between the Parties regarding the subject matter herein, including, without limitation, that certain Interim Water Supply Agreement by and between the Authority and the City, dated November 16, 2006, and that certain First Amendment to Interim Water Supply Agreement by and between the Authority and the City, dated March 1, 2013 (collectively, the “Prior Agreement”).
