This agreement (“Agreement” or “Service Description”) is made between the customer (“you” or “Customer”) and Dell Marketing L.P. or the Dell entity identified on Customer’s invoice or order confirmation (“Dell”). The invoice or other order confirmation containing a description of the covered Computer Device (as defined herein) you purchased is hereby incorporated into this Agreement by reference. In instances where Customer purchased this Service through a reseller or distributor, final prices and terms and conditions of sale will be as agreed between Customer and the third party from which Customer makes such purchases; however, the terms set forth herein are applicable to your use of the Service and the performance of Services by Dell. By purchasing these Services (as defined herein) from Dell, Customer agrees to be bound by all terms and conditions set forth in this document.
