Whereas, the Kentucky Energy and Environment Cabinet, an agency of the Commonwealth of Kentucky, has established certain regulations in 401 KAR Chapter 39, applicable to the Grantor, requiring that an owner or operator of a hazardous waste site or facility or group of facilities must demonstrate financial responsibility for bodily injury and property damage to third parties caused by sudden accidental and/or nonsudden accidental occurrences arising from operations of the facility or group of facilities.
