Comal County provides habitat for the black-capped vireo (Vireo atricapillus) and the golden- cheeked warbler (Setophaga chrysoparia) which are listed as endangered under the federal Endangered Species Act of 1973, as amended, 16 U.S.C. § 1531, et seq. (Act). To provide an alternative to the burden of each landowner or public or private developer going through an individual 10(a) permit application process under the Act, Comal County developed the Comal County Regional Habitat Conservation Plan (RHCP) to accompany an incidental take permit (ITP) application in accordance with Section 10(a)(1)(b) of the Act. The United States Fish and Wildlife Service (USFWS) issued the ITP (permit number TE-223267-2), herein referred to as the Permit) to Comal County effective November 25, 2015.

The United States Fish and Wildlife Service (USFWS) issued the ITP (permit number TE-xxxxxx-0, herein referred to as the Permit) to Comal County on xxxxxxxxx.
