These Terms of Sale and Software License Agreement (“Terms of Sale”) are entered into by and between Cisco Systems Korea Limited, locatedat 5th Floor, 517 Yeongdong-daero, (Samsung- dong) Gangnam-gu, Seoul, Republic of Korea (“Cisco”) and you (“Customer”), for Products and Services, unless Cisco and Customer enter into or have entered into another agreement (including but not limited to a written, click-wrap, click-and-accept or electronic agreement) regarding the purchase and license of the specific Cisco Products or Services being purchased and such agreement is in effect at the time the applicable Purchase Order is received by Cisco (the “Existing Agreement”), in which case the termsand conditions of such Existing Agreement shall govern the purchase andlicense of those Cisco Products or Services.

These Terms of Sale and Software License Agreement (“Terms of Sale”) are entered into by and between Cisco Commerce India Private Limited, a company incorporated under the provisions of the Companies Act, 1956 and having its registered office at 201 & 202 (2nd Floor) Prestige Loka, 7/1 Brunton Road, Bangalore 560025, India (“Cisco”) and you (“Customer”), for Products and Services, unless Cisco and Customer enter into or have entered into another agreement (including but not limited to a written, click-wrap, click-and-accept or electronic agreement) regarding the purchase and license of the specific Cisco Products or Services being purchased and such agreement is in effect at the time the applicable Purchase Order is received by Cisco (the “Existing Agreement”), in which case the terms and conditionsof such Existing Agreement shall governthe purchase and license of those Cisco Products or Services.
