Abstract: The restrictive agreements by object are those that aim to prevent, restrict or distort competition and are, by nature, able to do so, as the agreement to fix prices. Due to the high suscepti- bility of distortion of competition, these agreements are incompatible with the internal market. The ability to distort competition can only be determined in the light of the legal and economic context of the agreement, having regard, in particular, to the position and the economic strength of the firms in the market. Therefore, this analysis is not formal, based on a list of agreements prohibited by type. The restriction of freedom of initiative, apparently serious in formal terms, may not present the ability to distort the competition because, for example, there is no significant competition between the parties.
