CITY OF BUDA ANNEXATION, DEVELOPMENT, AND MUNCIPAL UTILITY DISTRICT CONSENT AGREEMENT THE COLONY AT COLE SPRINGSJanuary 10th, 2020
DATE”), is hereby made by and between the CITY OF BUDA, TEXAS, a home rule municipality located in Hays County, Texas (“CITY”), Fred and Paula Trudeau (the “Trudeaus”), and Industrial Asphalt, LLC “Industrial Asphalt” (the Trudeaus and Industrial Asphalt being referred to collectively herein as the “LANDOWNERS”). Subsequent to its creation, Buda Municipal Utility District No. 1, a proposed municipal utility district to be created pursuant to Article XVI, Section 59 of the Texas Constitution and Chapters 49 and 54, Texas Water Code as contemplated by this AGREEMENT (“DISTRICT”), will become a party to the AGREEMENT. The CITY, DISTRICT, and LANDOWNERS may be referred to individually as “PARTY” and collectively as “PARTIES.”
