On September 10, 2018, an authorized representative of the United States Environmental Protection Agency (EPA) conducted an inspection of Respondent’s facility known as Ventura Foods, LLC at 1501 Orchard Avenue in Chambersburg, PA to determine compliance with the Oil Pollution Prevention Regulations promulgated at 40 CFR Part 112 (the “Regulations”) under Section 311(j) of the Clean Water Act, as amended, (33 U.S.C. §1321(j)), (the “Act” or “CWA”). As a result, EPA has found that Respondent, Ventura Foods, LLC, a corporation (Respondent), is a “person” as defined in Section 311(a)(7) of the Act, 33 U.S.C. § 1321(a)(7), who has violated the Regulations by failing to comply with the specific regulatory requirements noted on the attached SPILL PREVENTION CONTROL AND COUNTERMEASURE INSPECTION FINDINGS AND ALLEGED VIOLATIONS AND PROPOSED PENALTY FORM (“Alleged Violations Form”), which is
