SAN JOSE, a municipal corporation (hereinafter “SAN JOSE”), and the CITY OF MILPITAS, a municipal corporation (hereinafter “MILPITAS”). SAN JOSE and MILPITAS are sometimes referred to hereinafter collectively as the “PARTIES.”
