This Settlement Agreement (“Agreement”) is made effective as of the day of __, 2018 (“Effective Date”), by and between the City of Lincoln, Nebraska, a municipal corporation in the State of Nebraska ("City"), the West Haymarket Joint Public Agency, a political subdivision and corporate body politic of the State of Nebraska (“JPA”), and TDP Phase One, LLC, a Nebraska limited liability company (the “Company”). The City and Company shall sometimes hereinafter be referred to collectively as the “Parties” and individually as a “Party”.
