This Settlement Agreement and Release (the “Settlement Agreement”), effective as of the date of the last signature below, is made by and between Plaintiff Armando Caldera (“Plaintiff”), individually and on behalf of the class of persons Plaintiff seeks to represent (as defined hereinafter at § 2.1 ), and Defendant American Medical Collection Agency, A.K.A. Retrieval-Masters Creditors Bureau, Inc. (“Defendant”) (collectively, Plaintiff, the Class and Defendant are the “Parties”), subject to Court approval as required by Rule 23 of the Federal Rules of Civil Procedure.
