The Agreement addresses matters both within and outside the Commission’s jurisdiction. As discussed with Kayla Rost of the Commission’s Bureau of Investigation and Enforcement, all matters within the PUC’s jurisdiction will be the subject of separate applications for Commission approval at each of the three public rail-highway crossings mentioned in the Agreement. For instance, in the ongoing North Avenue litigation at Docket No. A-2018-3006432, Norfolk Southern and the City will submit a Petition for Settlement in regard to the plans, project costs and future maintenance responsibilities agreed to herein.
