The parties to this Advertiser Service Agreement (below, the "User Agreement") are Creative Clicks APAC BV. ("Creative Clicks Market") and you the Advertiser ("Advertiser" or "You"). Creative Clicks Market facilitates "Performance Marketing Programs" (as defined hereinafter) by providing marketing services via the Internet. This User Agreement shall govern participation in the Creative Clicks Market Marketing Service (the "Marketing Service"). Taking any step to order, or request the Marketing Service or otherwise use the Marketing Service constitutes Advertiser's assent to and acceptance of this User Agreement. Written approval is not a prerequisite to the validity or enforceability of this User Agreement and no solicitation of any such written approval by or on behalf of Advertiser shall be construed as an inference to the contrary.
