Black Tie Medical Inc. dba Tulip Medical Products ("TULIP") warrants to the original purchaser or, for products purchased through a TULIP-authorized reseller ("Reseller"), to the original end-user, that all TULIP-branded products will conform to the TULIP written product specifications ("Specifications") for the particular product, which can be viewed on the TULIP website or obtained by contacting TULIP or the Reseller, and will be free from defects in material or workmanship for the duration of the Warranty Period, as defined herein (the "Limited Warranty"). The Warranty Period is one (1) year from the original date of purchase of the product from TULIP or from a Reseller, or the specific period set forth in the Specifications for the product, whichever is shorter. It shall be the sole responsibility of the original purchaser or, if purchased through a Reseller, the original end-user to obtain up to date versions of the Specifications for the product prior to initial use.
