This Class Action Settlement Agreement and Release (the “Agreement”) is entered into by and between Waddell Williams (“Class Plaintiff”), on behalf of himself and the Settlement Class (as defined below), on the one hand, and Bluestem Brands, Inc. (“Defendant”), on the other hand. The Class Plaintiff and Defendant are sometimes collectively referred to herein as the “Parties.”
