This Settlement Agreement and Release (the “Settlement” or the “Agreement”) is made and entered by and between Plaintiffs Catherine Moody, Andrew Cohn, and Jamie Zuccaro, individually and on behalf of the Settlement Class (“Plaintiffs” or “Class Representatives”), on the one hand, and Defendant Hot Topic, Inc. (“Hot Topic” or “Defendant”), on the other hand (Plaintiffs and Defendant collectively, the “Parties”), and is subject to approval in the action entitled Jamie Zuccaro v. Hot Topic, Inc., Case No. 3:23-cv-1242 (D. Or.) pending in the United States District Court for the District of Oregon (the “Court”).
