MEMORANDUM OF UNDERSTANDINGMemorandum of Understanding • February 21st, 2019
_ _ (Homebuilder) and ICF Resources, LLC (“ICF”), agree as of this _ _ day of , 2019 ("Effective Date") to enter into this Memorandum of Understanding (“MOU”). WHEREAS, Homebuilder has agreed to participate in the incentive program (“Program”) offered by Texas-New Mexico Power (“TNMP”) by installing HVAC products (“Products”) described in Attachment A installed by a dealer, contractor or retailer (“Dealer”) at a promotional incentive pursuant to the terms more fully set forth herein; and WHEREAS, ICF manages the Program on behalf of TNMP; and WHEREAS, TNMP repays to Homebuilder the monetary value of the promotional incentive pursuant to the Program.
