The Buyer has the right to withdraw from this Contract if the Seller is in delay with the delivery the Product or a part thereof (or in delay with related activities, as described in Article III herein) for more than 30 days and/or if the Product does not meet all the specifications stated in the Seller’s tender or in Appendix 1 to this Contract. The Buyer is also entitled to withdraw from the Contract if insolvency proceedings were initiated against the Seller’s property pursuant to Act No. 182/2006 Coll., on Insolvency and Methods of its Resolution (Insolvency Act), as amended, in which the Seller is declared bankrupt, or if the petition to initiate insolvency proceedings against the Seller’s property was rejected due to lack of assets to cover the costs of such proceedings.
