This Service Agreement (the “Agreement”) is entered into as of the “Effective Date” set forth in the related ordering document (the “Order”) by and between Formetco Incorporated, a Georgia corporation (“Formetco”) and “Buyer” described in such Order. This Agreement contains the terms and conditions applicable to the provision of certain Services by Formetco to Buyer with respect to the “Covered Hardware” described in such Order. Such terms are in addition to, and not in lieu of, the Terms and Conditions governing Buyer’s purchase of the Covered Hardware (the “Terms and Conditions”), available at https://www.formetco.com/terms-and- conditions/;, and constitute an amendment to the Agreement referenced in the Terms and Conditions. Capitalized terms used but not otherwise defined herein shall have the same meanings given for such terms in the Terms of Conditions.
