Contract Type FiledAugust 19th, 2014The Authority may recover from the Hosting Supplier the Anticipated Savings that are not realised to the extent that such unrealised Anticipated Savings arise as a result of a Default by the Hosting Supplier. The Hosting Supplier shall have no liability for unrealised Anticipated Savings that arise as a result of a Default of the Hosting Supplier which occurs on or after the date that the final Service Commencement Date relating to the Hosting Services have been Achieved and all the Hosting Supplier’s Delivery Dependencies as identified in the Delivery Dependencies Log and agreed from time to time in accordance with the Change Control Procedure, the provisions of schedule 6.1 (Transition, Delivery and Acceptance Requirements) and/or the change control procedure in schedule 7 (Change Control Procedures) of the Master Services Agreement as applicable have been performed.
