THIS TENDER AND RELEASE AGREEMENT is made and entered into effective May 6, 2021 (“Effective Date”) by and between AMERICAN CONTRACTORS INDEMNITY COMPANY (hereinafter referred to as “Surety”), ALWAYS PAVING, INC. (hereinafter referred to as “Principal”), and TOWN OF YOUNTVILLE (hereinafter referred to as “Obligee”). Surety, Principal, and Obligee are hereinafter collectively referred to as “Parties”.
