This Addendum to the Agreement (as defined in the Subscription Agreement entered into between the Customer and Fourth) sets out additional terms and conditions applicable to the Salary Service product. It should be read in conjunction with and forms part of the Agreement. Please note that this Addendum is in three Parts. Part A sets out the further definitions applicable to this Addendum. Part B sets out terms that Fourth enters into in its own right with the Customer. The Parties acknowledge that many of the provisions in Part B are for the benefit of the Nominated Provider and that the Nominated Provider expressly takes the benefit of rights provided to Fourth or to the Nominated Provider in Part B (in each case both directly and/or indirectly) and the Parties expressly agree that the Nominated Provider, may take the benefit and enforce all such rights, in each case pursuant to the Contracts (Rights of Third Parties) Act 1999.
