This Class Action Settlement Agreement and Release (“Agreement” or this “Settlement Agreement”) is made by and between Plaintiffs MARCO DIMERCURIO and JOHN LANGLITZ (“Plaintiffs”), individually and on behalf of the putative class, the State of California pursuant to the California Private Attorneys General Act, and Defendant MARTINEZ REFININING COMPANY LLC (“Defendant” or “MRC”) (collectively the “Parties”), by and through their respective counsel of record. The Parties hereby agree to the following settlement which, if approved by the Court, resolves the pending case MARCO DIMERCURIO and JOHN LANGLITZ, on behalf of themselves and others similarly situated v. MARTINEZ REFINING COMPANY LLC, and DOES 1 THROUGH AND INCLUDING 25 filed in the Superior Court of California - Contra Costa County, Case No. MSC20-01257 (the “Lawsuit”).
