Turion Metro District No. 1 (Turion) has proposed to dedicate 2 Units in the Windy Gap Project to the Town in exchange for a water credit of 63 acre-feet per Unit with possible escalation credits, as explained below. The 63 acre-feet volume is based on the average annual yield of Windy Gap Units. The water credits will be used by Turion for water use within the proposed Turion development. Turion is currently under contract with the Platte River Power Authority (PRPA) for purchase of the Windy Gap Units and the purchase would be assigned to the Town pursuant to a Water Dedication Agreement, substantially in the form attached. The agreement also allows for a potential increase in the credits provided to Turion (escalation credits) if the Town approves an engineering analysis which shows that the actual operation of the Town system provides a yield of more than 63 acre-feet per Unit.
