In consideration of the terms and conditions set forth in this Property Purchase Agreement (the “Agreement”) SHARON ELLSWORTH, acting Trustee of The James A. Davis Revocable Trust dated January 24, 2007 (“GRANTOR”) shall deposit in an escrow designated by the CITY OF MARTINEZ (“CITY”), a Grant Deed suitable for recordation and conveying from GRANTOR to CITY fee simple title as indicated in Exhibit “A”, incorporated herein by this reference, covering the property particularly described therein (collectively “Subject Property”).
