This article provides a discussion of the current protections provided for the Great Lakes, and calls for an international binding agreement to ensure their continued protection. All past agreements between the United States and Canada to protect the Lakes have been purely good faith, and have no binding effect on the parties. The Great Lakes states and provinces have committed themselves to a good-faith agreement that bans all major withdrawals or diversions, subject to three exceptions. This Agreement has no legally binding effect on the states and provinces. The states, however, have created a legally binding Compact that does not include the Great Lakes provinces. The Great Lakes states have the power to make decisions regarding major withdrawals or diversions of Great Lakes water without the consent of the provinces.
