This Agreement, hereinafter referred to as (the “Agreement”), dated June___, 2006, is drawn to represent the mutual consent of the undersigned parties, Hopkins Homes, Inc.a Kansas corporation, (“Hopkins”) and Forest Park Estates Homes Association, Inc., a Kansas non-profit corporation (the “Association”) to modify and update certain provisions of the Declaration of Restrictions for Plats 1-5, 6 and 7 for Forest Park Estates, a residential subdivision in the City of Shawnee, Johnson County, Kansas. Specifically, it is the intention of all undersigned parties to adjust certain provisions of those various Declaration of Restrictions, Addenda, and Agreements previously recorded with the Register of Deeds of Johnson County, Kansas(the “Recording Office”)as set out in “Recitals” below, in order to conform and tie all prior versions of deed restrictions to a uniform version for the express purposes of (i) updating building materials to reflect current standards/codes and (ii) to afford the As
