This Settlement Agreement and Release (the “Settlement Agreement”) is entered into by and between Plaintiff Randolph Frazier (“Frazier”), on behalf of himself and on behalf of all Putative FLSA Collective Members (as that term is defined herein), and the Board of Public Education for the City of Savannah and the County of Chatham, the body corporate responsible for public education in the City of Savannah and the County of Chatham commonly known as the Savannah-Chatham County Public School System (“SCCPSS”) (together, the “Parties”). This Settlement Agreement pertains to the alleged failure of SCCPSS (as that term is defined herein) to accurately pay Putative FLSA Collective Members full and complete overtime compensation due primarily to certain alleged non-discretionary bonuses not being included in the regular rate of pay.
