(this “Ninth Supplemental Agreement”), and effective from the time of execution and delivery hereof, is by and between the MARYLAND TRANSPORTATION AUTHORITY (the “MDTA”), an agency of the State of Maryland (the “State”), acting on behalf of the Department of Transportation of Maryland (the “Department”), and THE BANK OF NEW YORK MELLON, a banking corporation duly organized and existing under the laws of the State of New York, as trustee (including predecessors and successors, the “Trustee”).
